These Terms of Service (“Terms”) govern your access to and use of the website and services operated by Future-Forward Visionary (“we,” “us,” “our”). By accessing our website, browsing, or placing an order, you agree to be bound by these Terms. If you do not agree, do not use the site.

1) Eligibility and Acceptance

You must be able to form a legally binding contract to use this site and purchase products. By using the site, you represent that you meet this requirement and that any information you provide is accurate and complete.

2) Use of the Website

You agree not to misuse the site. This includes attempting unauthorized access, interfering with site operations, introducing malware, scraping content without permission, or using the site for unlawful purposes.

3) Products, Pricing, and Availability

We sell premium products, many of which may be shipped directly from manufacturers or authorized suppliers.

Product descriptions, images, specifications, and availability are provided for convenience and may change without notice. We do our best to display accurate information, but we do not guarantee that all listings are error-free.

Prices and promotions are subject to change at any time. We reserve the right to correct errors (including pricing errors), update listings, and cancel orders affected by inaccuracies.

4) Orders and Payment

By submitting an order, you authorize us (or our payment processor) to charge your selected payment method for the total amount shown at checkout, including any applicable taxes.

We reserve the right to refuse, limit, or cancel any order for any reason, including suspected fraud, pricing errors, stock constraints, fulfillment limitations, or misuse of promotions. If an order is canceled after payment is captured, we will issue a refund to the original payment method.

5) Shipping, Delivery, and Service Area (Lower 48 Only)

Unless otherwise stated, we ship only to the contiguous United States (lower 48 states).

Many items we sell are large and may ship via freight. Unless explicitly stated otherwise:

Freight shipments are curbside delivery (not inside delivery).
The carrier may require an appointment and a signature at delivery.
You are responsible for ensuring delivery access (adequate space, driveway access, gate codes, etc.).

Delivery dates are estimates only and are not guaranteed. We are not responsible for delays caused by carriers, weather, supply chain disruptions, or other factors outside our control.

6) Freight Delivery Inspection Requirement

For freight deliveries, you must inspect the shipment upon arrival. If the packaging shows damage:

Note the damage on the delivery receipt before signing,
Take clear photos of the packaging and product, and
Contact us promptly.

Failure to document visible damage at delivery may limit or prevent carrier claims and may affect available remedies.

7) Returns and Refunds Policy (All Sales Final Except Defects/Damage)

Due to the nature and size of many items we sell, all sales are final.

We do not accept returns or provide refunds for reasons such as buyer’s remorse, ordering the wrong item, changes in preference, or fit/space planning issues.

A return, replacement, or refund will be considered only if:

The item arrives defective, or
The item arrives damaged, or
You receive the wrong item.

To be eligible, issues must be reported within 48 hours of delivery and supported with photos/video evidence. Remedies may include replacement parts, repair, replacement, or refund depending on the product, supplier, and situation.

8) Cancellations

Orders may be canceled only before they have been processed or shipped. Once an order enters fulfillment or has shipped, it cannot be canceled.

9) Warranties and Manufacturer Support

Many products are covered by a manufacturer warranty. Warranty terms vary by product and manufacturer and are subject to the manufacturer’s warranty policies.

We may assist with initiating warranty claims when appropriate, but warranty determinations (including repair vs replacement) are controlled by the manufacturer/supplier.

To the fullest extent permitted by law, we disclaim all warranties except as expressly stated in a written manufacturer warranty.

10) Customer Responsibilities

You are responsible for:

Confirming measurements (doorways, room dimensions, ceiling height) and site constraints before ordering.
Confirming electrical requirements and compatibility where applicable.
Following product instructions for installation, assembly, and safe use.
Obtaining any permits, inspections, or approvals if required.

We are not responsible for installation labor, site modifications, electrician/contractor costs, permitting costs, or other third-party expenses.

11) Prohibited Use; Resale and Commercial Use

We may limit or refuse orders that appear to be placed for improper purposes, including fraudulent activity or misuse of promotions. If you intend to resell products purchased through the site, you are responsible for compliance with applicable laws and any manufacturer restrictions.

12) Intellectual Property

All content on this site—including text, images, graphics, logos, design elements, and product content—is owned by us or our licensors and is protected by intellectual property laws. You may not copy, reproduce, distribute, or exploit any site content without our prior written permission.

13) Privacy

Your use of the site is also governed by our Privacy Policy. If a Privacy Policy is posted on the site, it is incorporated by reference into these Terms.

14) Limitation of Liability

To the fullest extent permitted by law, Future-Forward Visionary will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, arising from or related to:

Your use of (or inability to use) the site,
Products purchased through the site,
Shipping delays or carrier issues,
Any third-party installation, assembly, or service.

Our total liability for any claim related to a product or order will not exceed the amount you paid for the product in that order.

15) Indemnification

You agree to indemnify and hold harmless Future-Forward Visionary and its owners, officers, employees, contractors, and partners from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of:

Your breach of these Terms,
Your misuse of the site,
Your improper installation, use, or handling of products,
Your violation of any law or third-party rights.

16) Dispute Resolution and Binding Arbitration (Utah)

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

You agree that any dispute, claim, or controversy arising out of or relating to these Terms, the site, or any purchase (“Dispute”) will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

Arbitration rules and venue:

Arbitration will be conducted in the State of Utah, unless the parties agree otherwise.
The arbitration will be administered under the rules of the American Arbitration Association (AAA) in effect at the time the arbitration is initiated.
The arbitrator will have the authority to award any relief that a court could award, consistent with these Terms.

Class action waiver: You agree that disputes will be brought only in an individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding.

Confidentiality: The arbitration may be conducted on a confidential basis to the extent permitted by the applicable arbitration rules and law.

Court enforcement: Judgment on the arbitration award may be entered in any court of competent jurisdiction.

17) Governing Law

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law rules, except where federal law applies.

18) Changes to These Terms

We may update these Terms at any time. If we do, we will post the updated Terms on this page and revise the Effective Date. Your continued use of the site after changes are posted constitutes acceptance of the updated Terms.
